TERMS AND CONDITIONS

Governing All Red Tail Paragliding Activity

Effective Date: 05/09/2024

Please read carefully the following terms and conditions which form an important part of the contract for your paragliding activity (see “paragliding activity definition” below) with RED TAIL PARAGLIDING (hereinafter called ‘we’, ‘us’, ‘our’ or ‘RTPG’).

These terms and conditions cover any activities conducted by RTPG, its instructors and pilots or those subcontracted to fulfill our business needs in order to fulfill our contract with our clients.

Paragliding Activity Definition

Paragliding activities conducted with RTPG includes, but is not limited to: tandem paragliding flight, speed flying or mini-wing flying, paragliding instruction, coaching, mentoring, clinic(s), tuition, guidance, or any course pertaining to paragliding and it’s activities, holiday(s) / vacation(s) / tour(s), or any other activity; hereinafter called ‘paragliding’,  ‘trip’, ‘trips’, “course(s)”.

All clients, in order to participate in any paragliding activity with RTPG, must sign a release of liability waiver to participate releasing Red Tail Paragliding, its owners, employees, agents, and affiliates from any liability for personal injury, property damage, or other losses arising from participation in the Activities.

RTPG has the right to the final decision, interpretation, and application of these terms and conditions.

Insurance

Participants are encouraged to obtain their own insurance coverage for all paragliding activities, as Red Tail Paragliding’s liability is limited to the extent permitted by law. Valid and adequate travel and accident insurance is required for all RTPG trips, and by submitting your booking to us you are indicating that you have obtained such insurance that includes cover for paragliding and related activities and medical repatriation. You are required to carry and be able to show RTPG proof of this insurance if requested. Failure to do so may result in you being not allowed to take part in our trip or some of the activities therein, without any right to a refund. We will not be liable for any costs you may sustain as a result of invalid or inadequate insurance. We also recommend obtaining cancelation travel insurance prior to booking.

How to book

All bookings can be made via our website https://redtailparagliding.com and must be made by a person 18 years old or over. In the case of a group booking this person is accepting these booking conditions on behalf of everyone in the group, and any requests for changes or cancelations must be done by this person.

In the case of tandem flights full payment is required to confirm your booking. For other trips booked a non-refundable deposit of 200 USD must be paid in order to secure your booking, with the remaining amount due no later than 2 months prior to the start date of the trip. For places booked less than 2 months in advance of a trip, immediate full payment is required to secure your place. If payment is not made within the stipulated time then your booking may be canceled and you will lose your deposit plus other relevant charges.

All payments made on credit card will be subject to a credit card fee of 3%.

We consider a contract to exist between us once your deposit has been received by us and you have received a confirmation email from us. It is your responsibility to check this confirmation email to confirm all details are correct, and if not to contact us immediately.

At the time of booking full disclosure of any medical conditions which may be relevant to or have any impact upon your health and safety or the safety of others in the group is obligatory. Red Tail Paragliding reserves the right to refuse participation to individuals deemed unfit for paragliding.

Prices

While prices are accurate as of the date published, we reserve the right to change any of those prices if we deem necessary.

If you change or cancel your booking

If you cancel your tandem flight booking 24 hours or more in advance, then you will be refunded your money minus a $50 non-refundable deposit per flight. If you cancel your booking less than 24 hours in advance then we will retain 100% of the booking amount.

Because we start to incur expenses from the time your contract is confirmed, if you cancel your trip more than 2 months before the start of your trip we will retain the 200 USD deposit. If you cancel between 1 and 2 months before the start of your trip then we will retain 50% of the total trip cost, and if you cancel less than 1 month before the start of your trip then we will retain 100% of the trip cost.

All communications related to any contract (whether a tandem flight or any other trip), particularly relating to cancelations, shall be made in writing and in English, and shall be considered as having been delivered once a response from RTPG is sent acknowledging receipt of the communication.

If we change or cancel your booking

If we need to reschedule your tandem flight booking for any reason (e.g. unsuitable weather conditions, paragliding location unavailable, pilot sickness, etc) then we will seek to offer you an alternative day or time as close to your original booking as possible without any additional charge. If we offer alternative options but you do not accept any of them then a refund minus $50 per flight will be offered.

In circumstances where we need to completely cancel the tandem flight due to external events outside our reasonable control, refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

For other trips, we reserve the right to cancel or change your booking or change any of the facilities, services or prices if we deem necessary due to changes in circumstances. We will strive to advise you of any such changes as soon as we become aware of them.

If any circumstances dictate so, we reserve the right to cancel your trip if we deem it necessary, including because of a failure to reach the minimum number of bookings for that trip. If we are required to cancel the trip due to no fault or failure by you, then we will refund monies already paid by you less any unrecoverable costs already incurred. If we are forced to cancel a trip after your departure or during a trip then we will, wherever possible, assist you in making suitable alternative arrangements.

We will not be held liable for any loss, penalties, or costs resulting from changes or cancelation of your trip. We therefore strongly recommend that you undertake suitable insurance prior to booking any travel or trips which covers you for any such cancelation or alterations to your travel bookings and any other accommodation or service bookings which may not be refundable.

Our liability, Conditions of Carriage, & Limitations

Our duty, and that of suppliers and service providers we contract, is to take reasonable care and skill in providing the services and facilities for which you contract us to undertake on your trip. It must be recognized that standards of safety, hygiene, and quality can vary between destinations, including medical care, and as such undertaking a trip with us is an acceptance of standards which may differ from what might be expected elsewhere. Your booking a trip is also taken as acceptance of the risks and hazards involved in such a trip, including disease, injury or death, loss of or damage to property, discomfort and inconvenience. It is understood that circumstances may dictate changes in the itinerary, and thus any itinerary shall be understood to be indicative of the planned activities and schedule and not prescriptive or a contractual obligation on our part.

We accept no responsibility or liability when a failure to provide your trip in any way or any death or personal injury suffered during the course of a trip is not proven to be caused by us, our agents, or suppliers when acting within the scope of our/their agreed roles and responsibilities, or if due to unusual or unexpected circumstances outside of our/their control.

For any international conventions which apply to or govern any of the facilities or services included in your trip which we have organized, we will adhere to any conditions or limits of liability afforded by such conventions, including the time allowed for bringing any claim and the type and limits of any damages or compensation which may be awarded. Outside of these applicable conventions or as detailed elsewhere in these booking conditions we shall have no legal liability whatsoever to you in regard to any loss or damage.

We shall have no liability whatsoever for any activities undertaken by you in the course of a trip with us if it has not formed part of the pre-booked itinerary which we have arranged and contracted prior to your departure. Any such activities you undertake are a contract solely between you and the activity provider, and the responsibility for any loss or damage arising out of that activity shall in no way be our responsibility. In the event of an accident or misadventure arising out of such activities we reserved the right to charge you a fee for any additional expenses incurred by us in assisting you in such a situation, with such fees being billed to you within 28 days of the final date of your trip.

As a weather dependent sport, paragliding trips may require changes to their planned itinerary and destinations to facilitate flying opportunities. There is however always the inherent risk of the weather being unsuitable for flying for part of or even all of a trip. In such a case we will consider our contractual commitments to you as being fulfilled and you accept the possibility of no paragliding activity taking place as an inherent risk with paragliding.

Client acceptance of risk

As an adventure aviation sport paragliding carries an inherent risk of injury and death or property damage. In areas where we operate there are factors which may increase these risks, including but not limited to reduced access to medical care and emergency transportation, lack of technical support or repair facilities, and lower standards of hygiene, security, and accommodation. Contracting a trip with us is taken as your understanding and acceptance of these risks, both in relation to paragliding but also all other aspects of the trip, and for which we cannot be held liable in any way.

Client suitability and independence

By booking any trip with us you are confirming that your health, both physical and mental, is sufficient and suitable for all aspects of the trip, including but not limited to paragliding. If you have any doubts about this then it is your responsibility to seek medical advice prior to making a booking with us to confirm your suitability. Your booking a trip thus indemnifies us against any claims for loss, injury or death as a result of your unsuitability, whether disclosed or not. You are also responsible to ensure that you obtain any relevant vaccinations or required medication for your trip.

Booking a trip with us is also a declaration by you that you are a suitably qualified and experienced pilot, both competent and autonomous, and also being suitable for a guiding environment. As a pilot you are expected and required to make independent decisions in relation to flying, including from where and whether to launch, decisions in the air, and in regards to landing. Guiding is given on an advisory basis, not as instruction, and you take all responsibility in making assessment and taking decisions regarding your suitability to fly and in regards to the flight thereafter. You must not fly unless you are fit to do so, including in regards to influence of any medication, drugs or alcohol.

You must also provide all your own equipment which is appropriate and well maintained.

As an independent and autonomous pilot you take all responsibility for any loss or damage that you may cause to your equipment, yourself, and any other third parties (including both person and property).

Indemnification

Participants agree to indemnify and hold harmless Red Tail Paragliding, its owners, employees, agents, and affiliates from any claims, damages, liabilities, or expenses (including legal fees) arising from their participation in the Activities.

Equipment

Red Tail Paragliding provides necessary equipment for the Activities, including paragliders, harnesses, helmets, and other gear while under training until the participant reaches P1. Afterwards the participant must use their own equipment. Participants agree to use this equipment responsibly and to follow all instructions provided by Red Tail Paragliding staff.

Right of refusal to any Red Tail Paragliding Activity

When booking with us you accept that RTPG reserves the right at any time to refuse any paragliding Activity; to guide or otherwise assist you in any way, whether permanently or temporarily, including termination of the remainder of your booking, without refund. Reasons for this may include but are not limited to a failure to display sufficient attention to safety, threatening, disturbing or disruptive behavior, damage to property, committing illegal acts, or a failure to show adequate evidence of the required insurance.

Local rules, laws, and customs

Permissions and authorisation for flying may be withdrawn at any time by local authorities in the areas where we seek to operate, or flying sites may be unavailable for other reasons beyond our control. As such, you accept without any liability to us that on your trip flying may be limited, disrupted, or not possible at all.

Local customs, traditions, and laws in the places you visit may be very different from your own country. You are advised to consult with the relevant embassy or consulate to obtain such information prior to your trip to ensure you are able to conduct yourself in such a way as to not offend local culture and traditions (including religious) and know and respect all local laws. Failure to do so, and any resulting consequences whether legal or otherwise, are solely your responsibility, and any cost, loss or damage suffered is entirely your own responsibility, including but not limited to any unused portion of your trip.

Complaints

In case of any issue or complaint about any aspect of your trip as arranged by us, you must immediately notify the trip leader who will seek to resolve the issue where possible. In case you are dissatisfied with the outcome please contact us by email to explain the situation within 14 days of the end of the trip. We endeavor to give a full response within 28 days of receiving your communication.

Visa, passport, travel documentation

While we may offer some advice regarding visa requirements, you are solely responsible to ensure you have any required visas and correct and valid travel documentation, including for any countries you may transit on the way to your final destination. Bear in mind that many countries require your passport to be valid for at least 6 months longer than your planned stay in the country. Some countries also request information regarding criminal records of people wishing to enter their country and may refuse entrance based on character grounds. It is your responsibility to ensure you have all the correct documentation to go on your trip, and it is recommended to contact the embassy or consulate of the country you will visit to ensure you have everything in order. We shall have no liability to you for any costs, loss or damage which you may suffer in regard to you being refused entry to a country or your expulsion there from. In such a case we will not refund to you any parts of the cost of your trip whether used or unused.

In case we are required to obtain any special permits locally to facilitate your trip (e.g. local paragliding permit) then we may require your passport details prior to the trip.

Your accommodation and special requests

Only those confirmed on the booking are permitted to stay in any accommodation arranged by us. You are solely responsible to pay for any damages or loss sustained in your accommodation (whether your own room or communal spaces) which can be attributed to you, including any extra charges for products or services you choose to utilize which we have not explicitly included as part of the trip, including but not limited to mini-bar and room service. Any such costs or charges must be paid by you locally before departure.

If you have any special requests relating to room arrangements or special dietary requirements, we will consider such requests where possible and inform you if there is an extra charge for these requests. It must be understood however that in some circumstances it may not be possible to deliver on special requests even when sought by prior arrangement.

Trip notes

Any trip notes pertaining to your trip which we issue are to be considered as part of the contract between us for your trip. Should there be any variation between information on the trip notes and that on the website or any other location/format, then the latest set of trip notes provided by us are to be considered as the most up-to-date. It is your responsibility to carefully check these trip notes and take any action as necessary.

Law and Jurisdiction

Any dispute or claim related to or arising from your booking will be governed by the local law of the country in which the trip takes place and the local courts shall have exclusive jurisdiction over any claim arising out of it.

With regard to paragliding Activities within the United State these Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Colorado. Any disputes arising from these Terms and Conditions or the Activities shall be subject to the exclusive jurisdiction of the courts in Boulder/Boulder County, Colorado, United States.

By participating in Red Tail Paragliding Activities, participants affirm that they have read, understood, and agree to these Terms and Conditions, including the Disclaimer of Warranties, Limitation of Liability, and Law and Jurisdiction provisions. Participants further acknowledge that they are responsible for their own safety and assume all risks associated with paragliding.
